Court Strikes Down Colorado Law Restricting Abortion Pill Reversal

Ruling Allows Medical Professionals to Offer Abortion Pill Reversal, Citing Religious Freedom and Patient Choice

A Colorado district court has issued a permanent injunction, blocking a state law that prohibited medical professionals from offering abortion pill reversal to patients. The ruling comes as a victory for pro-life advocates who argued the law infringed on the religious freedom of healthcare providers and limited choices for women.

The lawsuit, Bella Health and Wellness v. Weiser, was initially brought by the Becket Fund for Religious Liberty on behalf of a pro-life pregnancy center, Bella Health and Wellness.

However, the ruling’s reach was expanded to include licensed nurse practitioner Chelsea Mynyk and her clinic, Castle Rock Women’s Health. Mynyk had faced an investigation from the Colorado State Board of Nursing after an anonymous complaint was filed regarding her provision of abortion pill reversal treatment.

According to the Alliance Defending Freedom (ADF), which represented Mynyk, the court’s decision affirms that the state cannot force women to continue with a chemical abortion if they change their minds. The ADF highlighted that abortion pill reversal is a “safe and often effective treatment” for women who regret their decision and wish to reverse the effects of the first abortion drug.

The court’s opinion acknowledged that the law burdened the plaintiffs’ “sincerely held religious beliefs” by preventing them from offering a specific treatment. It also noted that while the clinical efficacy of abortion pill reversal is a subject of debate, there have been no reported injuries, and a number of women have successfully given birth after receiving it.

Kevin Theriot, ADF Senior Counsel, praised the ruling, stating, “Government officials can’t silence medical professionals and prevent them from saving lives.” He added that the court was right to rule that the state “can’t force women to follow through with a chemical abortion when a safe alternative is available.”

The court’s decision permanently blocks the Colorado law, ensuring that licensed medical professionals like Mynyk can continue to offer abortion pill reversal to patients who seek it.
